NGOs' Association expresses concern over the delay in awarding timely promotion of HGCs & Head Clerks

The Non-Gazetted Govt. Officers’ Association has expressed concern over the delay in awarding timely promotion of HGCs and Head Clerks in the AC Cadre of Andaman and Nicobar Administration. In a letter, addressed to the Secretary(Personnel), the Association has drawn attention towards a good number of HGCs and Head Clerks waiting for their promotion since a long period. It was also pointed out that in spite of clear cut vacancies in the post of Head Clerk and Office Superintendent, the promotion to these employees are delayed stating the reason of providing required training. It is a well known fact that the responsibility for conducting the required training lies with the Administration and it is a complete injustice that the promotions to these deserving employees are delayed stating such a reason.

The Association has also suggested for imparting training to Head Clerks on seniority basis and also providing a one-time exemption of regular promotion to the Office Superintendents who are on ad-hoc basis.

STRIKE NOTICE FOR 2ND SEPTEMBER STRIKE SHOULD BE SERVED BY ALL AFFILIATED ORGANIZATIONS ON 11TH AUGUST 2015.

Dear Comrades, The National Executive Committee meeting of the Confederation of Central Government Employees & Workers was held at New Delhi on 12.07.2015. Affiliated organizations, General Secretaries of State Committees (COCs) and CHQ office Bearers attended the meeting. Com. K. K. N. Kutty, National President, Confederation, presided. After detailed deliberations for about six hours, the meeting took the following important decisions.

(I) 2nd SEPTEMBER 2015 NATIONAL STRIKE:

1. Confederation and all its affiliated organizations shall participate in the Nationwide one day strike on 2nd September 2015 as per the call of all Central Trade Unions and independent Federations.

2. Charter of demands on which the strike is being organised on September 2nd by Confederation shall include

(1) 12 point common charter of demands affecting all sections of the Indian working class and

(2) 10 point charter of demands of the central government employees formulated by the National Joint Council of Action.

(See Charter of demands attached – Annexure-I)

3. Intensive campaign should be conducted among all Central Government Employees by each individual organisation by holding General body meetings, conventions, office-to-office campaign and gate meetings. Notices, pamphlets and posters should be printed and circulated to all offices and employees. Wide publicity should be given through print and electronic media. All websites of affiliates shall exhibit the campaign details, photos etc.

4. Confederation CHQ Leaders shall visit all important centres throughout the country between August 16 to 31st and address Joint Conventions/meetings of the employees. Meetings should be organised by the state/District level units of the Confederation (C-O-Cs). Advance planning should be made by the C-O-Cs to make the campaign programmes of Al India Leaders a grand success, by ensuring maximum participation of employees from all affiliated organisations (Details of the campaign programme will be published in the website within two days.)

5. State/District Units of the Confederation shall plan and organize their own campaign programmes at state/District level.

6. Strike notice will be served by Confederation CHQ to the Cabinet Secretary, Government of India on 11th August 2015. On the same day each individual affiliated organsiation of the Confederation should also serve strike notice to their respective Departmental heads. Demonstrations in front of all important offices should be held on 11th August 2015. Copy of the strike notice served by each organisation should be sent (email) to confederation CHQ.

7. All affiliated organisation shall make maximum efforts to ensure participation of maximum number of employees in the 2nd September strike. More than 10 crores organised and unorganised workers will be participating in the strike.

8. All affiliated organizations should issue their own separate circulars to all the lower units directing the Branch/District/Divisional/State/Circle level leaders to start campaign work immediately and also to ensure maximum participation of employees in the strike.

(II) 23rd NOVEMBER INDEFINITE STRIKE:

1. Confederation and all its affiliated organizations shall commence their own independent intensive campaign especially among grass-root level workers from now onwards.

2. At the same time Confederation state/District level leadership (C-O-Cs) should take initiative to organize joint conventions of National Joint Council of Action at maximum possible centres.

3. Immediately after the 2nd September strike and after submission of report by 7th CPC, the Confederation National Executive will meet again and decide further programmes to intensify the campaign programme for the success of 23rd November indefinite strike.

4. A Resolution adopted by the National Executive regarding 2nd September one day strike and 23rd November indefinite strike is enclosed herewith.

(III) OTHER DECISIONS:

1. The All India Two days Women’s Workshop of Confederation will be held at Hyderabad on 9th & 10th October 2015. About 150 lady delegates from all affiliates and C-O-Cs will attend the workshop. Quota fixed for each affiliate and C-O-Cs will be circulated shortly. Delegate fee per head is fixed as Rs. 500/- (Rs. Five Hundred only). All affiliated organizations and C-O-Cs are requested to ensure maximum participation in the workshop. Travel tickets of the delegates may be booked well in advance.

2. Next National Conference of the Confederation will be held at Chennai (Tamilnadu) before September 2016. The Tamilnadu state Committee of the Confederation (C-O-C) shall finalise the dates/month in consultation with CHQ. Efforts may be made to hold the Conference in July itself.

3. Financial position of the Confederation CHQ was reviewed. It is noticed that many affiliates have not remitted their due quota. It is decided to instruct all affiliates to clear their quota arrears before 31st August 2015. Delegates to the National Conference will be fixed based on the quota remitted by each affiliated organizations and C-O-Cs. Needless to say that for smooth functioning of the CHQ and also for undertaking campaign programmes funds is a must.

4. Decided to nominate Com. R. Seethalakshmi, Convenor, Women’s Sub Committee, Confederation to the Women’s Committee of the Trade Union International (TUI)-Public an allied services functioning under world Federation of Trade Unions (WFTU)

5. Decided to grant affiliation to the following organizations

(a) Forest Survey of India Employees Association Dehradun (Uttrakhand).

(b) Employees Association of Directorate of Forest Education Dehradun Staff, Dehradun (Uttrakhand)

6. Decided to extend full support and cooperation for the successful conduct of the Asia-pacific region meeting of the Trade Union International (TUI) – Public and Allied Services at Delhi during the month of November 2015.

ANNEXURE – I

2ND SEPTEMBER 2015 STRIKE CHARTER OF DEMANDS

PART-I

1. Urgent measures for containing price-rise through universalisation of public distribution system and banning speculative trade in commodity market.

2. Containing unemployment through concrete measures for employment generation.

3. Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measure for violation for labour laws.

4. Universal social security cover for all workers

5. Minimum wages of not less than Rs. 15,000/- per month with provisions of indexation.

6. Assured enhanced pension not less than Rs. 3000/- P.M. for the entire working population.

7. Stoppage of disinvestment in Central/State PSUs.

8. Stoppage of contractorisation in permanent perennial work and payment of same wage and benefits for contract workers as regular workers for same and similar work.

9. Removal of all ceilings on payment and eligibility of bonus, provident fund; increase the quantum of gratuity.

10. Compulsory registration of trade unions within a period of 45 days from the date of submitting applications; and immediate ratification of ILO Convention C 87 and C 98.

11. Against Labour Law Amendments

12. Against FDI in Railways, Insurance and Defence.

PART-II

1. Effect wage revision of the Central Government Employees from 01.01.2014 accepting memorandum of the staff side JCM; ensure 5-year wage revision in future; grant interim relief and merger of 100% of DA; Include Gramin Dak Sevaks within the ambit of 7th CPC. Settle all anomalies of 6th CPC.

2. No Privatisation, PPP or FDI in Railways, Defence Establishment and no corporatization of Postal services.

3. No ban on creation of new posts. Fill up all vacant posts.

4. Scrap PFRDA Act an re-introduce the defined benefit statutory pension scheme.

5. No outsourcing, contractrisation, privatization of governmental functions; withdraw the proposed move to close down the printing presses, the publications, form stores and stationery departments and medical stores Depots; regularize the existing daily-rated/casual and contract workers and absorption of trained apprentices.

6. Revive the JCM functioning at all level as an effective negotiating forum for settlement of the demands of the Central Government Employees.

7. Remove arbitrary ceiling on compassionate appointment.

8. No labour reforms which are inimical to the interest of the workers.

9. Remove the ceiling on payment on bonus

10. Ensure five promotions in the serve career.

ANNEXURE-II

RESOLUTION ADOPTED BY THE NATIONAL EXECUTIVE COMMITTEE MEETING OF THE CONFEDERATION HELD ON 12.07.2015 AT NEW DELHI.

1. The National Executive of the Confederation which met at New Delhi on 12.07.2015 decided unanimously to endorse the call of the Central Trade Unions and independent Federations in the country for organizing one day nationwide strike on 2nd September 2015 to oppose the ongoing aggressive neo-liberal economic policies of the Government of India. The National Executive has decided to call upon all its affiliates to organise intensive mobilization campaign to reach out to each and every Central Government employees. The National Executive has also decided to deploy the National and state leaders of Confederation for a wider campaign amongst the Central Government employees in all states and District capitals of the country.

2. The meeting also noted with grave concern the rejection of a 5 years wage revision for Central Government Employees by the 7th Pay Commission and consequent demand of the benefit of merger of DA an Interim Relief. The meeting also noted the advisory articles appearing in the corporate/controlled media against the wage revision of Central Government Employees to influence the recommendation of the 7th CPC. The meeting noted with grave concern the negative attitude of the Government towards three lakhs Gramin Dak Sevaks of the Postal Department by refusing to include them in the 7th CPC. The meeting decided to exhort the affiliates to bring the contents of the memorandum of the staff side JCM once again to the employees and prepare them for the proposed indefinite strike action of the CGEs including Railways and Defence workers from 23rd November 2015. It was also decided that besides the National charter of demands of prepared by the Central Trade Unions, the 10-point Charter of demands of the JCM staff side National Council shall form the combined charters of demands of the Central Government employees for the strike action on 2nd September 2015.

3. The meeting decided to appeal to all state committees and affiliated organizations to take active part in all meetings and conventions organised by Central Trade Unions, jointly with state Government Employees Federation, Bank, Insurance and other public sector undertakings. The Confederation and its affiliates shall serve strike notice for the 2nd September strike on 11th August 2015 by holding massive demonstrations at the respective work places.

NGOs' Association demands proper functioning of SBI ATMs

The Non-Gazetted Govt. Officers’ Association, Andaman and Nicobar Islands has expressed concern over the non-functioning of ATMs installed at various places in the Port Blair town.  In a letter sent to the Regional Manager of the State Bank of India at Port Blair, Shri TS Sreekumar, General Secretary of the Association while drawing  the attention of the  Regional Manager   on the hardship being faced by the general public and govt. employees due to the non-functioning of the ATMs of State Bank of India at Port Blair and surrounding areas said that most of the ATMs in the Port Blair city are in ‘Out of Order’ state and customers who are at receiving end, are facing difficulty in getting money on time due to the lethargy shown by the State Bank of India to repair their ATMs timely.  Shri Sreekumar pointed out that the ATMs at Raksha Vihar, Airport, Dairy Farm, Aberdeen (CCS), Delanipur, etc., are not functional and some of them are in unserviceable condition for the last few months. Long queue of customers are a common site in front of ATMs at Junglighat and e-corner, Port Blair.  People in need of urgent cash are the worst sufferers who are forced to use the ATMs of other banks for getting money, the Association pointed out.  He further said that it is a matter of serious concern that State Bank of India which is always claiming ‘better service’ is not taking the required initiatives for the upkeep of these ATMs.  The Association asked the Regional Manager to take immediate measures for the urgent repairing of all the unserviceable ATMs to ensure better service to the customers of the largest nationalized bank.

Delegation meets Prof. Ramshankar Katheria, Hon'ble Union Minister of State (HRD)

A delegation of the Non-Gazetted Govt. Officers’ Association, Andaman and Nicobar Islands led by Shri H L Prasad, President & Shri T.S.Sreekumar, General Secretary, met                 Prof. Ramshankar Katheria, Hon’ble Union Minister of State, Human Resource Development, Govt. of India who is on a visit to these islands on today (27.06.2015) at Port Blair. The delegation submitted a memorandum containing some of the issues of teachers which are pending with the Govt. of India. The issues include Grant of Part-B upgraded pay to the left-out categories of teachers, grant of ISDA during summer vacation and enhancement of Medical Allowance.

The delegation brought to the notice of the Hon’ble Minister the undue delay in extending the Part-B upgraded pay to certain categories of teachers viz., HM(P) & HM(M), Librarians, PETs, Craft Instructors, etc., working in these islands. The Hon’ble Minister was also requested to intervene in the issue of grant of ISDA to teachers during summer vacation which is already cleared by the Finance Ministry, Govt. of India. The delegation further invited the attention of the Hon’ble Minister to demand for the hike in Medical Allowance from Rs. 75/- to Rs.1000/- and requested him to take up the issue with the concerned Ministry.

            The Hon’ble Minister after giving a patient hearing to the delegation assured that the issues raised by the Association shall be taken up with the appropriate authority. The delegation of the Association also included Shri R.Surendran Pillai, Secretary and Shri S.L.Vinjit, Joint Secretary, of the South Andaman Teachers’ Branch. 

Happy News for Teachers on ISDA issue

As per a reliable information, Ministry of Finance, Govt. of India has conveyed its concurrence to MHRD for the grant of Island Special Duty Allowance (ISDA) to the teachers during summer vacation. Around 6000 vacation staff of Education Department and Lecturers of various colleges will be benefited by the decision if MHRD process the matter and issue necessary orders.

The  Non-Gazetted Govt. Officers' Association has been taking up this issue with the Ministry of Finance, MHRD and Ministry of Home Affairs since 2009. The Secretary-cum-Director of Education genuinely deserve appreciation for timely action with Govt. of India

REVISION OF TIME LIMIT FOR SUBMISSION OF FINAL CLAIMS FOR REIMBURSEMENT OF MEDICAL EXPENSES UNDER CS (MA) RULE, 1944-REGARDING

Subject: Revision of time limit for submission of final claims reimbursement of medical expenses under CS(MA) rules, 1944 – regarding.

The undersigned is directed to refer to OM No. F. 29-40/68-MA dated 15.10.1968 in which it was laid down that submission of final claims for reimbursement of medical expenses of Central Government servants in respect of a particular spell of illness should ordinarily be preferred within 3 months from the date of completion of treatment.

2. A representation was received from National Council (Staff Side) to extend the time limit for submission of such medical bills from 3 months to 6 months. The matter was examined in the Ministry and it has been decided that the period of 3 month s for submission of medical claims be revised to 6 months. Henceforth, only the cases in which the bills are submitted after 6 months from the date of completion of medical treatment/discharge of the patient from the hospital are required to be taken up for condonation. The power of condonation of such delays and other terms and conditions woukld be same as enumerated in the OM No.S.14025/8/99/-MS dated 25.05.1999.

Meeting with the 7th Pay Commission Satisfactory – NC JCM Staff Side

“Members of the National Council JCM, which represents over 40 lakh Central Government employees all over India, met with the team of higher officials of the 7th Central Pay Commission on 9.6.2015”

It was revealed that the meeting with the 7th CPC was very satisfactory. By the end of August, the committee will submit its recommendations and from Jan 2016, the new pay scale, including all the allowances, will be implemented based on this report.

Elaborate discussions were held on crucial issues like Principles of wage determination and Minimum Wage & Ratio of Minimum and Maximum Pay. Also, popular demands like qualification related pay scales, and grant of increment to those retiring on June 30 and December 31, were also presented.

Issues over the fixing of pension parity between past and future pensioners. And the discrepancies in these methods and retirement benefits including revision of pension were also discussed.

JCM urged that the Need-Based Minimum Wage concept to compute pay at the minimum level may be adopted. Pay Commission should take into account the outside rates to determine the pay package at senior levels of bureaucracy but maintain the ratio between the minimum and maximum at 1 : 8 (MTS to Secretary to Govt. of India).

Staff side demanded open- ended pay scales to ensure that no employee stagnates without increment. We have suggested only 14 Pay scales. Minimum of which is Rs. 26000 and Maximum Rs. 78000 for Group C employees. We suggested that the multiplication factor (26000/7000 = 3.7) may be applied uniformly in all the cases to arrive at the revised pay in the new scales of pay. We also suggested that the benefit on promotion, therefore, should be: two increments in the feeder cadre.

A request was made to rectify the defects in the MACP scheme. NC JCM insists to grant five promotions in the service career. It should be given on their hierarchical basis.

Staff Side requested to remove the ceiling of Rs.3500 and request to recommend to the Central to grant the bonus on the basis of the actual emolument of the employee.

The JCM demanded for Educational Assistance for two children, instead of two eldest children, and also to pay the same for Post Graduate and Professional Courses.

The National Council requested to the 7th CPC to review and recommend the scarping of NPS in the light of the observations made by Hon’ble supreme court that pension is a fundamental justify.

Responding to the invitation received from the Vllth CPC, the JCM (Staff Side) delegation met the Pay Commission this day 09th June 2015 and deliberated again in detail on the following issues:-

(a) Minimum wage — (15th ILC norms/Dr. Achroyed Formula for determining minimum wage as proposed in the JCM Staff Side Memorandum),
(b) Rate of increment.
(c) Fitment Formula,
(d) Qualification related Pay Scales,
(e) Pay parity for common categories.
(I) Date of effect of revised Pay Structure and allowances etc.,
(g) Upward revision of Ex-gratia to the families of employees killed in the course of performing duties,
(h) Parity in pension for eliminating the discrimination,
(i) Rectification of MACPS aberrations,
(j) Grant of increment to those retiring on 30th June and 31st December of the year.

Various other issues were also discussed with the VII CPC today. While the response of the Pay Commission by and large has been satisfactory on many points mentioned above, the revised pay structure/allowances is likely to be recommended to be given effect from January 1st, 2016. With today’s discussions in the final meeting with VII CPC, the deliberations by the JCM Staff Side got concluded.

It is expected that the VII th CPC would submit its report to the Government by the end of August 2015. Prominent leaders among those participated in the deliberations are Dr. M. Raghavaiah Leader (JCM) Staff Side, NFIR’ s President Guman Singh. Working President R.P.Bhatnagar and Joint General Secretary B.C. Sharma.

7th Central Pay Commission's Final Meeting with JCM Staff Side National Council on 9th June 2015 at 11 AM at New Delhi

Discussion in National Anomaly Committee Meeting held on 29.05.2015

The meeting of the National Anomaly Committee was held today at Room No. 72 , North Block.  Mrs. Mamatha Kundra, JS(E) Department of Personnel and Training chaired the meeting.  The Staff side was represented by:

1.      Com. M. Raghavaiah, Leader Staff Side, 2 Com.Shiv Gopal Mishra, Secretary, 3. Com. Bhosale (AiRF) .4. Com. Guman Singh(NFIR), 5. Com. K.K.N. Kutty(Confederation), Com. M.S. Raja ( Audit), Com. Srikumar (AIDEF)

The following issues alone were taken up for discussion at the meeting.  The next meeting of the NAC will be held on 9^th June, 2015afternnon, when the un-discussed items (12) of the agenda will be taken up.  The Staff side also pointed out the need to reach finality on all issues included in the agenda of NAC.

Item No.1. Review of MACP where Grade Pay of Rs. 2000/- is not available like Railways: The official side stated that the demand was to bring the hierarchy based MACP which may not be acceptable as it would disturb the uniformity across the Departments. They also said that in the background of 7^th CPC coming into being, no change in the scheme at this stage would be desirable.

Item No. 2. Grant of Addl. Pay to Loco and Traffic running Staff in Railways.   After some discussions, it was agreed that the DOE will cause a reconsideration of the issue.

Item No. 3. MACP for personnel appointed under LDCE and GBDCE scheme in Railways. The official side agreed that under the ACP if the appointees under LCDE and GDCE have been treated as direct recruitment, the same might be treated in the same manner under MACP.

Item No. 4. Grant of minimum entry pay meant for direct recruits to promotees.   The official side stated that unless logically it is established that the proposed stepping up is needed, the direction of the FM in the matter cannot be got reversed. There was serious discussion in the matter thereafter.  The Staff side stated that the RPA rules promulgated after the 6^th CPC recommendations were not in conformity with the Fundamental Rules on this issue.  They also stated that having once agreed to a position; the official side cannot withdraw there-from under the JCM Scheme.  They also stated that the course open to the official side was to present the case before the new Finance Minister.    On behalf of the Staff Side, the Secretary informed the official side that a rejection of an issue on which agreement is reached will not be taking lying down by the employees.  The Staff side also demanded that a meeting with the new Finance Minister be arranged so that they will be able to place this issue before his consideration.
