I draw your kind attention towards the discussion held by a delegation from this Association with you on 23rd October, 2009 when your goodself was kind enough to inform us that the demand for restructuring of the Amalgamated Clerical Cadre will be considered favourably and a proposal in this regard would be sent to the Govt. of India for its approval.
In this connection, we are of the opinion that since the restructuring does not involve any kind of additional financial implications or increase in the overall number of posts, it can very well be done by the A & N Administration itself. This will avoid unnecessary delay in the matter.

As per our decision taken at the last National Executive meeting we are to organize a human chain on 25.11.2009 in all Cities/Towns by eliciting massive participation of the members. The human chain is to connect two Central Government offices. Kindly take all necessary arrangements to make the programme a grand success.
There had been several suggestions from various affiliates and COCs to make certain amendments to the charter of demands. Taking this into account, we have decided to redraft the charter of demands. The revised charter of demands is as under:
a) To reduce the price of all essential commodities.
b) To rescind the orders on outsourcing of Governmental functions and closure of offices.

A meeting of the Executive Committee of the South Andaman Teachers’ Branch of the Non-Gazetted Government Officers’ Association was held at Crusade House, Phoenix Bay, Port Blair today (19.09.2009). The meeting discussed various pending issues concerning the teachers and expressed its dissatisfaction over the delay in resolving the issues. The meeting noted that the authorities in the Govt. of India and A & N Administration continue to neglect various genuine demands of teachers viz. (i) grant of Part B Grade Pay to Headmasters and other left-out categories of teachers (ii) ISDA to teachers during summer vacation (iii) allotment of sufficient funds to all DDOs under the Education Department to clear pending Transfer TA bills, (iv) clearing of all left-out cases under earlier ACP Scheme, (v) implementation of Modified ACP Scheme, (vi) regularization of adhoc services of teachers, etc. The meeting decided to go on agitation if the above demands are not settled immediately. The Confederation of Central Govt. Employees & Workers, New Delhi, to which the Non-Gazetted Govt. Officers’ Association, Andaman and Nicobar Islands is affiliated, has included two items/demands in the Notes submitted to the National Anomaly Committee of the Govt. of India. The demands/items are (i) inclusion of the posts of Headmaster (Primary) and Headmaster (Middle) in the Part B of the Central Civil Services (Revised Pay) Rules, 2008 and (iii) inclusion of miscellaneous categories of teachers like Physical Education Teacher, Primary School Resource Teachers, Music Teacher, Art Teacher, Librarian, Craft Instructor, Lab Assistants, etc. in the Part B of the said rules. The National Anomaly Committee will consider the above points and will take a decision on it. After the introduction of the recommendations of the Sixth Central Pay Commission, it was noticed that Headmasters of Primary Schools and Middle Schools are allowed lower Grade Pay while the teachers working under them are getting higher Grade Pay. Similarly, a number of categories of miscellaneous teachers, as mentioned above, who were treated at par with other teachers by the earlier Pay Commissions, have been left out of the upgraded Grade Pay under Part B by the Sixth CPC. The Association has been demanding rectification of this anomaly ever since the introduction of the Sixth CPC recommendations.

This Association has been demanding, for the last several years, that adequate provision in the B.E and R.E. stages be made by all the Drawing & Disbursing Officers under the Education Department under the DTE as Transfer TA/Tour TA Bills of teachers were not being processed and settled by the DDOs in time on the reason of non-availability of funds. Our efforts to impress upon the authorities in this regard evoked no fruitful results so far, with a number of bills kept pending for years together by the DDOs.
On the one hand, teachers are stand relieved on a particular date thereby denying them of the opportunity to draw Transfer TA Advances, etc. and on the other, their Transfer TA Bills are kept pending for 1-2 years at the places of their new postings. This has generated a lot of resentment among the teachers over the years.
Now, this Association has received reports from our Branches at various outstations and Port Blair/South Andaman areas that there is no change in the situation and a large number of Tour TA bills, LTC/AFSP bills, etc. of teachers are kept pending for a long period by some of the DDOs under the Education Department on the pretext of non-availability of funds.
I would, therefore, request you kindly to look into this matter and take appropriate steps to ensure that sufficient funds are allotted to all the DDOs under the Education Department to clear all the pending Tour TA bills/Transfer TA bills, LTCF/AFSP bills, etc.
Action taken in the matter may please be intimated to this Association.

Madam,
While welcoming you to these historic and serene islands, this Association would bring to your kind notice some of the issues/problems concerning the teachers working under the Education Department as under:
1. Grant of Part B Grade Pay to Headmaster (Primary) and Headmasters
(Middle):
Headmasters of Primary and Middle Schools are being denied the enhanced Grade Pay under Part B on the plea that their posts do not find place in Part B of the CCS (RP) Rules, 2008 even though the Primary School Teachers and Graduate Trained Teachers working under them have been given the enhanced Grade Pay. Even the enhanced Grade Pay which the PSTs and GTTs were getting has been lowered once they become Headmasters (Primary) and Headmasters (Middle). This is illogical and unjust, as lowering of Pay on promotion with higher responsibility cannot be accepted at any cost. A decision in this regard may kindly be taken at the earliest so that the Grade Pay of a large number of Headmasters(Primary) and Headmasters (Middle), some of them have already retired from service or on the verge of retirement, can be restored to them.
2. Inclusion of Left-out categories of teaching and miscellaneous staff
in the Part B.
It has been noticed that several categories of teachers and miscellaneous teaching staff have been excluded from Part B of CCS (Revised Pay) Rules, 2008. These categories are Physical Education Teachers, Primary School Resource Teachers, Music/Art Teachers, Librarian, Craft Instructor, Lab Assistant, etc. Till the introduction of the Sixth CPC recommendations, the above categories of staff were equally treated along with other teaching staff. Govt. of India may kindly be moved to consider this case favourably so that hundreds of employees belonging to the above categories will get the benefit of enhanced Grade Pay under Part B.
3. ISDA to teachers during summer vacation:
We have noticed with concern that due to certain misconception and mis-interpretation of the orders/rules, the teachers are not being allowed the newly sanctioned Island Special Duty Allowance during summer vacation. Since the vacation staffs are always treated as on duty and not as on leave during summer vacation, the teachers are eligible for ISDA during summer vacation. However, this allowance has been denied to vacation staff on the plea that they are on leave. In some schools, it has been granted for 15 days and in many other schools ISDA has been completely dis-allowed. Education Department, in consultation with the Pay & Accounts Organisation, should settle this issue so that thousands of vacation staff will get the benefit of ISDA during summer vacation.
4. Fixation of Pay consequent on grant of ACP:
Pay fixation of a large numbers of teachers are yet to be done by several Heads of Offices(DDOs) under the Education Department consequent on the grant of ACP to teachers. Arrears of pay fixation benefits are not being drawn and paid to them. We request that suitable instructions may please be issued to all the DDOs under the Education Department to complete the above work immediately.
5. Non-availability of sufficient funds for Transfer TA:
We regret to bring to your kind notice that despite this Association’s repeated requests, the Education Department/A & N Administration do not earmark sufficient funds for the Transfer TA of teachers. While on the one hand, teachers are stand relieved after their transfer from one station to other and thereby denying them of the benefit of drawing advances of Transfer TA, etc., on the other their Transfer TA bills are kept pending for 2 – 3 years at their new places of postings on the plea of non-availability of funds. We would request you kindly to ensure that sufficient funds are allotted to the Education Department for the Transfer TA, etc. We would also request that action may be taken against the DDOs who do not furnish correct figures while finalizing the Budget Estimates/ RE, etc.
6. Timely supply of textbooks to schools:
It has been observed that every year textbooks are not being supplied to the schools at the time of re-opening of the schools. Many of the textbooks are made available to the book depots/ schools at the middle of the academic session. Poor students are the worst affected due to this delay. Teachers are also facing difficulty to teach in the absence of textbooks for students. This may also kindly be looked into.

ISDA to teachers during Summer Vacation

Sir,
I am to state that the vacation staff working in the Education Department of the Administration have not been paid the Island Special Duty Allowance during summer vacation-2009. While in some of the schools, the ISDA has been paid to teachers for one month viz. May, 2009 or 15 days only, but in some other schools the same has not been at all drawn and paid to the teachers. ISDA has been granted to the employees with the condition that the same will not be admissible during their absence on Leave/Training beyond 15 days at a time and beyond 30 days in a year and during suspension/joining time, but there is no mention about the summer vacation specifically in the orders of the Govt. of India.
In this connection, your kind attention is invited to FR 82 (b) under which the summer vacation for teaching staff is deemed as duty. This was re-iterated in the Govt. of India’s decision 3 below rule 28 of CCS (Leave) Rules, 1972 wherein Ministry of Finance in consultation with the Ministry of Home Affairs, have clarified the position. It is, thus, clear that the summer vacation for the teachers is not leave and as such denial of ISDA to teachers during summer vacation on the misconception of being on leave is illegal, arbitrary and unjustified.
I would, therefore, request you kindly to look into this matter and issue necessary instructions to the Education Department and Director of Accounts and Budget to allow ISDA to all the vacation staff of the Education Department during summer vacation and, thus, render justice to thousands of teachers and other vacation staff.

Sir,
I am to invite your kind attention to the O.M. No. 1/1/2008-IC dated 24th December, 2008 issued by the Department of Expenditure, Ministry of Finance, Govt. of India (copy enclosed for kind reference) wherein the points of doubts on the training to be given to Group D staff who do not possess the revised minimum qualification for grant of Pay Band -1 Grade Pay were clarified by the Govt. of India. According to the said O.M., “Each administrative department concerned will design a training curriculum suited to its requirements. As far as possible, the training programme should not exceed 3 months and it may be imparted during working days for not more than 2 hours per day…..” However, it has been noticed that none of the departments under the Andaman and Nicobar Administration has designed any training curriculum, because of which training to non-metric staff is yet to begin.
Your kind attention is also invited to Note 1 below rule 7 of the CCS (Revised Pay) Rules, 2008 (copy enclosed for kind reference) wherein it was mentioned that “(b) Such of those existing Group D employees who do not possess the revised minimum qualifications for entry into PB-1 would be retrained by the concerned Department preferably within a period of six months so that payment of arrears on account of upgradation are not delayed. After retraining, these Group D staff will also be placed in the Pay Band PB-1 with the grade pay of Rs. 1800 with effect from 1.1.2006 and arrears drawn accordingly….” I regret to inform you that almost all the departments have failed to obey the said direction of the Govt. of India even after 11 months of implementation of the said rules. Hundreds of Group D employees of various departments have been denied of the upgraded Grade Pay in Pay Band -1 as recommended by the Sixth CPC and accepted by the Govt. of India due to the inaction on the part of the Heads of Departments under the Andaman and Nicobar Administration.
Discontentment among the above category of employees is increasing and this Association cannot remain silent on this injustice being meted out to them.
Under the circumstances, I would request you kindly to intervene in the matter and issue immediate necessary direction to all the Heads of Departments so that Group D employees working under the A & N Administration who do not possess revised minimum qualification for PB-1 Grade Pay will get their due benefits which were to be implemented long back and, thus, render justice to this lower strata of the workforce in the Administration.

PRESS STATEMENT on Union Budget
The Union Budget 2009-10 presented in the Lok Sabha today (06.07.2009) does not give any solace to government employees and workers reeling under skyrocketing prices of essential commodities mocking at the official claim of declining inflation rate. The Non-Gazetted Govt. Officers’ Association expresses its displeasure over the in-action on the part of the Finance Minister to consider various pending demands of government employees and workers. The nominal increase in the Income Tax limit will be of no use for government employees in the context of hike in their wages following the introduction of Sixth Central Pay Commission. Nothing has been said in the Budget about post creation and new recruitment in central government even though a number of new schemes have been announced and implemented over the years. And in the same breath the budget pleads about the tainted process of selling public assets of government companies in the name of disinvestment. Instead of using part of the huge reserves and surpluses with central public sector undertakings to the tune of Rs 4.85 lakh crore for creating productive assets for employment generation, the public sector undertakings are being put on sale in phases for so-called fiscal deficit management.

The Annual Conference of the Non-Gazetted Govt. Officers’ Association, Andaman and Nicobar Islands being held on 25 – 26 April, 2009 at Port Blair, notes with concern that there is no forum available in Andaman and Nicobar Islands for discussion and resolving the issues of government employees working under the Administration. There are about 26000 government employees and workers under the A & N Administration. A number of issues/demands put up by this Association, which is the largest Service Association in the islands, every year are not being considered favourably. The Union Territory of Andaman and Nicobar Islands is directly administered by the Govt. of India through the Ministry of Home Affairs. The Association notes that demands/problems of government employees working under the Andaman and Nicobar Administration can be resolved if a Regional Council of the Joint Consultative Committee (JCM) under the Ministry of Home Affairs is formed in these islands.
The Annual Conference of the Association, therefore, resolved to urge upon the Govt. of India to take immediate steps to set up a Regional Council of the JCM under the Ministry of Home Affairs, Govt. of India, so that the issues/ demands can be discussed and resolved amicably.
Note on Upgraded Pay of Headmasters & Left out category of Teachers
BRIEF NOTE ON THE DEMAND FOR UPGRADED PAY UNDER PART B OF CCS (REVISED PAY) RULES, 2008 FOR HEADMASTERS (PRIMARY) AND HEADMASTERS (MIDDLE) UNDER THE ANDAMAN AND NICOBAR ADMINISTRATION

On the recommendations of the Sixth Central Pay Commission, the Govt. of India has granted upgraded pay for teachers, Vice Principals and Vice Principals and it has been included in Part B of the Central Civil Services (Revised Pay) Rules, 2008. Grade Pay for the next Grade of each category of teachers has also been mentioned in the said rules, leaving no room for any ambiguity. However, it has been noticed that this upgraded pay has not been extended to the Headmasters (Primary) and Headmasters (Middle). Most of the Headmasters (Primary) and Headmasters (Middle) have already got the 1st and 2nd financial upgradation under the ACP Scheme in the posts of Primary School Teacher and Graduate Trained Teacher respectively, before they became Headmasters and before the effective date of implementation of the 6th CPC recommendations and were drawing the pay scales of teachers. On becoming Headmasters, these Headmasters were not given any Pay Fixation benefits as they were already in the same scale of pay or more than that.
As per Part B of the CCS (RP) Rules, 2008, the Grade Pay of PST is Rs. 4200. Grade Pay of Rs. 4600 is allowed to the PST on getting 1st ACP and Rs. 4800 is extended to PST on getting 2nd ACP. Since the post of Headmaster (Primary) has not been included in the Part B, they have been given the replacement Grade Pay of Rs. 4200 which is the Grade Pay of Entry Grade PSTs. In the same way, the Grade Pay of Entry Grade Graduate Trained Teacher (GTT) is Rs. 4600. Grade Pay of Rs. 4800 is extended to GTTs on getting 1st ACP and Grade Pay of Rs. 5400 is given to GTTs on the award of 2nd ACP. However, the Headmaster (Middle) on promotion from GTT is given the replacement Grade Pay of Rs. 4200 only on

the plea that the post of Headmaster (Middle) does not find place in the Part B of CCS (RP), Rules, 2008. In certain cases, the Headmasters who got upgraded Grade Pay from 1.1.2006 while being a teacher, have been brought down to the Grade Pay of Entry Grade GTT/PST on their promotion to the post of Headmaster (Middle)/Headmaster (Primary). In this way, these Headmasters have been not only denied the financial benefits they were already enjoying but their subordinate teachers are placed at higher Grade Pay.
Non-Gazetted Govt. Officers’ Association, Andaman and Nicobar Islands consider this as an injustice meted out to the Headmaster (Primary) and Headmasters (Middle) and needs urgent rectification.
It is, therefore, submitted that this issue may please be considered favourably and the Headmaster (Primary) and Headmaster (Middle) may also be included in Para XVII of Section II of Part B in the CCS (Revised Pay) Rules, 2008 as has been done in the case of Vice Principal, Principal, Education Officer, Asst. Director of Education, etc., in order to remove the anomaly in the Grade Pay and also to end the injustice meted out to the above categories of teaching staff.

Director of Education, etc. and it has been included in Part B of the Central Civil Services (Revised Pay) Rules, 2008. Grade Pay for the next Grade of each category of teachers has also been mentioned in the said rules, leaving no room for any ambiguity. It has, however, been noticed that certain categories of teaching staff have been excluded from the list. They are Physical Education Teachers, Primary School Resource Teachers, Music/ Art Teachers, Librarians, Craft Instructors, etc. The above categories of teachers were always considered for all kinds of benefits that were extended to the teaching community by the government in the past. In regard to Physical Education Teachers, Librarians and Craft Instructors, they have already been notified as ‘Miscellaneous Categories of Teachers’ in 1986 and 1997 by the 4th and 5th Central Pay Commissions respectively.
The Non-Gazetted Govt. Officers’ Association, Andaman and Nicobar Islands, is of the opinion that no category of teachers should be left out of the upgradation of pay under Part B as it will demoralise the affected categories which in turn will badly affect the teaching-learning process in the educational institutions.
It is, therefore, submitted that the above issue may kindly be considered favourably and upgraded Grade Pay be extended to the above-mentioned left-out categories of teaching staff working under the Education Department of Andaman and Nicobar Administration.

Sir,
The Department of Personnel & Training, Government of India has issued a Modified Assured Career Progression Scheme for the central government employees vide No. 35034/3/2008 –Estt (D) dated the 19th May, 2009. This order has already been circulated to all the Heads of Departments/ Offices under the A & N Administration. However, it has been noticed that no step has been taken by the Heads of Departments/ Offices to implement the scheme for their employees.
The MACP is operational with effect from 1st September, 2008 and all the pending cases upto August, 2008 have to be settled on the basis of the earlier ACP Scheme (of August, 1999). A large number of employees in various departments and also under the Amalgamated Clerical Cadre are yet to be granted financial upgradation under the former ACP Scheme.
I would, therefore, request you kindly to issue necessary instructions to all the Heads of Departments/Offices under the Administration to implement the Modified ACP Scheme and also to grant financial upgradation under the earlier ACP Scheme to all the eligible employees working under them.

Transfer of large number of APWD employees to PRIs

Sir,
It has been reported to this Association that a large number of workers and employees of APWD have been transferred and posted to Zilla Parishads. The workers and employees have been stand relieved of their duties on the same day of issuing the order. This has created inconvenience and hardship for these workers and employees, as they never experienced such a transfer in the past.
The above transfers were made hurriedly in the midst of general elections and in brazen violation of Model Code of Conduct. The devolution of powers and deployment of staff to PRIs were lingering over the years and the Administration made little effort to resolve the issue. Even our suggestion for deployment of staff (we are sending a separate letter to you on this subject) have not been considered by the Administration. We feel that piece meal transfer of employees to PRIs will not serve any purpose, rather it will complicate the issue. Before taking a final decision and completing the formalities for such re-deployment/ transfer of staff, any hasty decision on the part of a particular department to transfer such a large number of employees to PRIs need to be reconsidered.
I would, therefore, request you kindly instruct the authorities in the APWD to keep in abeyance all the transfer orders of workers and employees to PRIs till the modalities for deployment of staff to PRIs are completed after taking into consideration the views of Service Associations and unions.

Granting ACP to PGT's
The Non-Gazetted Govt. Officers’ Association, Andaman and Nicobar Islands has expressed its gratitude to the Secretary (Education) and Director of Education and other concerned officials of the Directorate of Education for granting the financial upgradation under ACP Scheme to Post Graduate Teachers working under the Education Department. The Department has now issued orders granting financial upgradation to the above category of teachers. It was due to the relentless struggle and persuasion by the Non-Gazetted Govt. Officers’ Association that the ACP benefit has been granted to the Post Graduate Teachers. The Department had earlier kept pending the case due to mis-interpretation of the ACP order issued by the Govt. of India.
Nursing allowance to CHO's

Sir,
It has been reported to this Association that Community Health Officers working under the Health Department are not being paid the Nursing Allowance even though they are part of the nursing functions. It is observed that various categories of staff like Matron, ANM, LHV, Public health Nurse, etc. are getting the Nursing Allowance while the same is denied to the CHOs. Being part of the health care system, the CHOs are also eligible for Nursing Allowance. The guidelines issued by the Health Department elaborating the duties and responsibilities of CHOs show that they are carrying out the clinical work. In fact, they have been getting this allowance till a few years back and it was unilaterally dis-continued on untenable reasons.
I would, therefore, request you kindly to examine this case and grant the Nursing Allowance to all the Community Health Officers working under the Health Department as has been done in the case of other similarly placed employees and, thus, render justice to them.

Non Availability of Ships & Flights during Summer Vacation

As your goodself may kindly be aware, the summer vacation for the schools in Andaman & Nicobar Islands starts from 1st May 2009. Hundreds of teachers and other government employees along with their family members will be proceeding to mainland to visit their home towns and also for other purposes during summer vacation. The government employees find it difficult to get any ticket either in the ship or in flight for proceeding to mainland. Two passenger ships of the shipping department / SCI viz. M.V.Nancowry and M.V. Harshavadhana have been sent to Dry Dock on the mainland for APS and as such these ships are not available for service between Port Blair and mainland during summer vacation.
Hundreds of government employees and workers are stranded at Port Blair due to the non- availability of Ship or flight tickets.
Administration’s decision to send the two passenger ships for APS during this rush season has caused great hardship for the government employees and workers. Even seriously ill patients are not getting tickets to proceed to mainland for medical treatment.
Under the circumstances, I would request your goodself to take up the matter with the Govt. of India to introduce chartered flights between Port Blair and Kolkatta / Chennai till the arrival of the above said passenger ships from APS in order to clear the summer vacation rush in the islands.

Hundreds of government employees of Andaman and Nicobar Islands and their family members who have to visit their home towns on the mainland or to visit mainland for various purpose, are stranded in the islands due to non-availability of flight tickets (.) Indian Airlines is operating one flight each from Chennai and Kolkata to Port Blair daily which is insufficient to meet the summer vacation rush here (.) No additional flight between Port Blair and Kolkata/Chennai sector has been announced by the Indian Airlines so far (.) Tickets are also not available even for patients referred to mainland hospitals (.) Government servants are forced to buy tickets from private airlines on exorbitant fare (.) Government employees are in an agitated mood here (.) This Association seek your kind intervention to have some additional flights by Indian Airlines between Chennai-Port Blair and Kolkata – Port Blair in order to ease the summer vacation rush in the above sectors (.) Action taken in the matter may kindly be intimated to this Association urgently (.)
