DA likely to be announced on Monday

Central D.A. likely to be cleared by cabinet on Monday evening

It is all set to approve 7% D.A. for Central employees and pensioners by the cabinet. The cabinet meeting scheduled on Friday, the 21st September has been rescheduled on Tuesday and then advanced to Monday (24/09/2012) evening.

Once approved the total Dearness Allowance payable from 1st July 2012 will be 72% of total pay. Employees are likely to get 3 months arrears in cash and the enhanced pay will be effected from the salary of October 2012. Pensioners are likely to get it with the pension of October 2012.

Procession to protest the Hike in Diesel price & restriction imposed on subsidized LPG cylinders

          The Non-Gazetted Govt. Officers Association, Andaman and Nicobar Islands & CITU jointly organized a procession at Port Blair today (22nd September, 2012)  to protest  against  the government’s recent decision to hike the price of diesel and restricting the subsidized LPG cylinders to 6 Nos. The procession which began from Crusade House premises at 4.45 p.m. went round the Aberdeen bazaar area and culminated near Tiranga Park. Shri B.Chandrachoodan, General Secretary, CITU, A & N State Committee and Shri Anand Raj of NGOs’ Association addressed the gathering. In a symbolic manner, an empty LPG cylinder was carried in front of the procession to highlight the demand for retaining the present LPG cylinder supply without any restriction. Shri S.Surender, Vice President, Shri D. Ayyappan, General Secretary, Shri TS Sreekumar, Asst. General Secretary of the Association led the procession. Braving the drizzling, a large number of Govt. employees & workers participated in the procession.

NGOs' Association expresses concern over Diesel Price Hike

The Non-Gazetted Government Officers’  Association, Andaman and Nicobar Islands expresses its anguish and  concern  over the decision of the central government to increase the diesel price by 5 rupees per litre and to reduce the subsidized LPG cylinder to six.  This decision of the government will have a cascading effect on the price rise.  Prices of all the items especially food items will increase.  Besides, it will be nightmare for the lower middle and poor strata of the society including the lower category of government employees and workers who are already reeling under the uncontrolled price rise caused by wrong policies of the successive central government. Limiting the subsidized LPG cylinder to six in an year will upset the monthly budget of the above categories of people.  The Association demands the central government to roll back the decision to hike the diesel price and to limit the subsidized LPG cylinders.  The Association along with other trade unions in the islands will conduct a series of agitation on the above issue in the coming days.

Death Anniversary of Com. N.Vasudevan observed

The 15th Death Anniversary of  Shri N. Vasudevan, former Counsellor (Health), A & N Administration and former General Secretary, Non-Gazetted Govt. Officers’ Association  was observed today  (4th September, 2012).  To mark the occasion,   a Seminar on “Working Class Unity in the Present Situation” was organized at 5 p.m.  today at Hotel ACC, Mohanpura, Port Blair by the Non-Gazetted Govt. Officers’ Association jointly with the  Centre of Indian Trade Unions.  Speaking on the topic as the main speaker, Shri KG Das, former General Secretary of the Non-Gazetted Govt. Officers’ Association said that the policies of the successive central government have led to job loss to lakhs of people following closure of industries.   He said that for the first time in the  history of  trade union movement,  almost all the central trade unions, keeping aside their political affiliations,   have come together to  fight against the anti-labour policies of the  government and conducted  nation-wide  movements in the recent past.  Tracing out the origin of trade union movement in Andaman and Nicobar Islands, Shri KG Das said that Shri N. Vasudevan’s contribution to the working class movement in the islands cannot be forgotten. Shri P.Banerjee, former President of the Association also spoke on the occasion.  Shri D. Ayyappan, General Secretary welcomed the  gathering while Shri TS Sreekumar, Asst. General Secretary proposed  Vote of Thanks.  A large number of government employees and workers and retired employees attended the programme.

Clerical Cadre Issues taken up in New Delhi



During their recent visit to Delhi, D.Ayyappan, General Secretary and TS Sreekuamr, Asst. General Secretary of the Non-Gazetted Govt. Officers' Association has pursued the following pending issues in the Ministry of Home Affairs and Department of Personnel & Training:
a)      NFSG to HGCs: On a request made by the Association, the A & N Administration had sent a proposal to the Ministry of Home Affairs, Govt. of India to take up with the Ministry of Finance for extending the scheme of Non-functional Selection Grade (NFSG) in the Grade Pay of Rs. 4200/- to the Higher Grade Clerks with 5 years of service. The matter was pursued with the Home Ministry during the visit by the above leaders.
b)     Upgraded Pay for Asst Secretary and OS: The issue of upgraded pay for the Assistant Secretary and Office Superintendents of A & N Administration  is pending with the Ministry of Home Affairs. The officials in the MHA assured of speedy action in the matter.
c)      MACP Issues: The clarification sought for by the Personnel Wing, Secretariat from the Department of Personnel & Training, Govt. of India on MACP upgradation to those who have completed 10 years in a particular grade/post was followed up with the concerned officials in the DoPT.
d)     Exemption of ISDA from Income Tax: General Secretary has submitted Memorandum to the Secretary (Revenue) in the Ministry of Finance and Chairman, Central Board of Direct Taxes urging them to exempt the ISDA from Income Tax which will benefit thousands of employees working in these islands. The matter was further pursued during the recent visit to Delhi by the Gen Secretary and Asst. Gen Secretary.

1.      Extending Upgraded Grade Pay to Headmasters, PETs, LIbrarians, CIs etc.: During their recent visit to Delhi, D.Ayyappan, General Secretary and TS Sreekuamr, Asst. General Secretary of the Non-Gazetted Govt. Officers' Association had met Shri Kapil Sibal, Hon'ble Minister of Human Resource Development and submitted a letter urging him to extend the upgraded grade pay under Part B to Head Maters, PETs', Librarains, CIs etc. The Minister directed the Joint Secretary (School Edn.) and other officials present in the meeting to expedite it. The delegation had also met Smti. Anshu Vaish, Secretary, Department of School Education & Literacy, Ministry of Human Resource Development, Govt. of India and requested her to settle the issue without any further delay. The proposal in this regard which was sent to the MHRD from A & N Admn three years back, was lying in the Ministry of Finance for the last two years and it was only due to the efforts of the General Secretary that the file is now in the MHRD.
2.      Grant of ISDA to teachers during summer vacation: During their meetings with the Hon’ble Minister of HRD and Secretary (School Edn.), Ministry of HRD, the General Secretary and Asst. Gen Secretary had raised this issue. This matter was originally taken up with the Finance Ministry by the A & N Administration and Comrade Basudeb Acharya, MP. The matter is being pursued by the Association with the Ministry.

Shipping Department Sub-Committee formed...

          A meeting of the employees working in the Afloat Section of the Shipping Department was held on 4th August, 2012 at Port Blair in which it was decided to form the Shipping Department Sub-Committee of the Non-Gazetted Govt. Officers’ Association.  Addressing the meeting, Shri D. Ayyappan, General Secretary of the Association said that various issues and demands of the government employees in general and those belonging to the Shipping Department like (1) Revise the OTA Allowance rate and Night Duty Allowance, (2) remove restrictions on compassionate ground appointments, (3) stop down sizing, privatization and outsourcing, (4) Scrap New Pension Scheme, etc. are yet to be considered by the Govt. of India.  Shri Lawrence Fernandez, former President, Shri TS Sreekumar, Assistant General Secretary and Shri Anand Raj, Secretary, Secretariat Sub-Committee of the Association addressed the meeting.   The meeting decided to take up various pending issues of the employees of the Shipping Department with the authorities in the Department and in the A & N Administration.  The meeting elected Shri M. Sakthivel as President, Shri Biswajit Biswas as Secretary and Shri Egnesh Kerkitta as Treasurer of the newly formed Shipping Department Sub-Committee of the Association.

Govt. orders modifying a condition on Compassionate Appointments

OFFICE MEMORANDUM

Subject:- Review of three years time limit for making compassionate appointment.

The primary objective of scheme for compassionate appointment circulated vide O.M. No. 14014/6/94-Estt(D) dated 09.10.1998 is to provide immediate assistance to relieve the dependent family of the deceased or medically retired Government servant from financial destitution i.e. penurious condition. The Hon'ble Supreme Court in its judgment dated 05.04.2011 in Civil Appeal No. 2206 of 2006 filed by Local Administration Department vs. M. Selvanayagam @ Kumaravelu has observed that "an appointment made many years after the death of the employee or without due consideration of the financial resources available to his/her dependents and the financial deprivation caused to the dependents as a result of his death, simply because the claimant happened to be one of the dependents of the deceased employee would be directly in conflict with Articles 14 86 16 of the Constitution and hence, quite bad and illegal. In dealing with cases of compassionate appointment, it is imperative to keep this vital aspect in mind".

2. This Department's O.M. No. 14014/6/ 1994-Estt. (D) dated 09.10.1998 provided that Ministries/Departments can consider requests for compassionate appointment even where the death or retirement on medical grounds of a Government servant took place long back, say five years or so. While considering such belated requests it was, however, to be kept in view that the concept of compassionate appointment is largely related to the need for immediate assistance to the family of the Government servant in order to relieve it from economic distress. The very fact that the family has been able to manage somehow all these years should normally be taken as adequate proof that the family had some dependable means of subsistence. Therefore, examination of such cases call for a great deal of circumspection. The decision to make appointment on compassionate grounds in such cases was to be taken only at the level of the Secretary of the Department/Ministry concerned.

3. Subsequently vide this Department's O.M. No. 14014/19/2002-Estt. (D) dated 5th May, 2003 a time limit of three years time was prescribed for considering cases of compassionate appointment. Keeping in view the Hon'ble High Court Allahabad judgment dated 07.05.2010 in Civil Misc.Writ Petition No. 13102 of 2010, the issue has been re-examined in consultation with Ministry of Law. It has been decided to withdraw the instructions contained in the O.M. dated 05.05.2003.

4. The cases of compassionate appointment may be regulated in terms of instructions issued vide O.M. dated 09.10.1998 as amended from time to time. The onus of examining the penurious condition of the dependent family will rest with the authority making compassionate appointment.
